Arizona immigration law hearing ends with no decision

PHOENIX – A federal judge in Phoenix did not rule on whether to block a new Arizona immigration law on Thursday after two hours of testimony at the hearing first and foremost one of the seven challenges for strict enforcement.

The Phoenix police officer who filed the suit could be dismissed if it does not enforce the law has filed a lawsuit to block, a lawyer said U.S. District Judge Susan Bolton, who did not say when he had to decide whether end the law before its entry into force on 29 July.

Lawyers for Governor Jan Brewer, said U.S. District Judge Susan Bolton demand – by Officer David Salgado and nonprofit groups statewide Chicanos Por La Causa – should be rejected as Salgado and lack of standing group and that no valid claim of immediate harm.

But Salgado’s lawyer did not agree.

“He has a real threat,” said attorney Stephen Montoya. “They can fire him. That’s enough.”

Bolton is considering blocking the law and whether to dismiss the lawsuit. She can not act before the law is established with effect from 29 July.

Hearings on the six demands, including one by the federal government, are set for next week.

Protesters and supporters gathered outside the law courthouse, separated by at least seven Phoenix police officers carrying guns and handcuffs.

About two dozen supporters, many dressed in red, white and blue, held signs praising Maricopa County Sheriff Joe Arpaio, a major endorsement of the crackdown on illegal immigrants, and one that says “American Pride” .

Larry Templeton, 66, of Sun City, said he came to support the bill because he believes in the rights of states.

“They are saying it is racist. It’s not against any race, is anti-criminal,” said Templeton, who wore an American flag T-shirt and a hat with American flag buttons.

About 10 feet away, about 30 people who opposed the law held banners calling for their repeal.

“We demand an injunction. We demand federal intervention,” shouted opponent Sandra Castro of Phoenix, 22, into a megaphone.

The law requires police, while the application of other laws, the question of the status of a person if immigration officers have a reasonable suspicion that the person is illegally in the country.

Supporters say the law was necessary because the federal government has not adequately confronted illegal immigration in Arizona, the busiest illegal entry of immigrants into the United States. Opponents say the law would lead to the establishment of racial profiling and distract the attention of the police official “traditional in the fight against crime in their communities.

Montoya said the U.S. Separate Department of Justice challenge to the Arizona law strengthens the argument of their customers that state law is unconstitutional. Both lawsuits argue that state law intrudes on the federal government’s constitutional authority to set and enforce immigration policy and regulation.

“That’s one more opinion,” said John Bouma, a private attorney representing Brewer. “The fact that filed the complaint did not mean they are right.”

From Brewer signed into law April 23, was inspired by the meetings in Arizona and elsewhere by proponents of both sides of the immigration debate. Some opponents have called for a boycott of tourism in Arizona.

It also led to an undetermined number of illegal immigrants to leave Arizona for other American states or their countries of origin and asked the Obama administration to file a lawsuit to invalidate the law.

Salgado lawyers argued that the judge should block the law before its entry into force, as it would require an officer to use race as a primary factor in the application of the law and because state law is defeated by the federal immigration law.

Brewer’s attorneys asked that the formal demand will be thrown out because Salgado alleges no real threat of harm to enforce the new law and instead bases its claim on speculation. He also said state law prohibits racial discrimination and is not overcome by federal immigration law because it does not purport to regulate the conditions under which people can enter and leave the country.

The other challenges to the law were submitted by the U.S. Department of Justice, civil rights organizations, religious groups, a researcher at Washington and a police officer in Tucson.

Bolton is scheduled to hold similar hearings on July 22 lawsuits filed by the federal government and civil rights groups.

very simple explanation: Immigration is not a crime but a civil offense punishable by deportation. Its application is exclusive Federal Authotiites.
States therefore can not make their own laws “criminalize” immigration is the real question so if there was an immigration reform that language can be there and then and only then can the local application to do this work.

While some might argue that racial profiling is to ask for documentation of residence, no one has considered the fact that if you are a U.S. resident who has been held (eg by a traffic violation) for as simple as showing your driver’s license to confirm their status as U.S. citizen. Driving without a valid U.S. license drivers, or any other documentation of identity would be an ideal reason to detain someone until their identity can be determined. If you can not find in the system address and social security number, then yes, it is a reasonable assumption that the detainee is not a U.S. citizen and immigration services should be contacted.

I just saw a Fox News video of some cameras set up on federal land by the Center for Immigration Studies posted within 15 miles of the border, and Casa Grande Sector (80 miles inside the border). The video shows hundreds of foreigners including armed drug dealers walking calmly through the border without any sign of police or border guards. The cameras can record infrared and columns of illegals was the day and night.

What kind of government we have to authorize these flagrant violations take place and choose to spend our tax dollars rather than punish a state for trying to enforce the law?

The way we read things like this (the “Dream Act”) is that on the surface of the ratings appear to kill some people and it seems difficult to achieve, but the caveat is that the government has demonstrated that it enforces on the books, if so would not have the problem. .
